Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and 3OHT LLC, a Delaware limited liability company (“Company,” “we,” “us,” or “our”), governing your access to and use of the Albert TCU platform available at albert.study (the “Service”).

By creating an account, starting a free trial, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Albert TCU is an educational audio platform designed to help users prepare for the TCU AUFC (Tribunal de Contas da União — Auditor Federal de Controle) examination in Brazil. The Service provides approximately 1,600 audio lessons covering 16 subject areas of the exam syllabus, with synchronized subtitles and commentary on past exam questions from CEBRASPE.

All educational content is delivered in Brazilian Portuguese (pt-BR). The Service is accessed through a web-based application and requires an internet connection.

3. Account Registration

To use the Service, you must create an account by signing in with a Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old.

4. Free Trial

The Service offers a seven (7) day free trial period (“Free Trial”). To start the Free Trial, you must provide a valid credit card or other accepted payment method. No charges will be applied during the Free Trial period.

You may cancel the Free Trial at any time during the seven-day period through the subscription management portal accessible within the application. If you cancel during the Free Trial, your payment method will not be charged, and your access to the Service will end immediately upon cancellation.

Each user is entitled to only one Free Trial. We reserve the right to determine eligibility for the Free Trial and to withdraw or modify the Free Trial offer at any time without prior notice.

5. Payment and Billing

If you do not cancel during the Free Trial period, your payment method will be automatically charged a one-time fee of R$ 200.00 (two hundred Brazilian Reais) at the end of the seven-day trial. This is a single, non-recurring charge.

By providing your payment information and starting the Free Trial, you expressly authorize us to charge the applicable fee to your payment method at the end of the trial period unless you cancel before that time.

All payments are processed securely through Stripe, Inc., our third-party payment processor. We do not store your credit card information on our servers. Your use of Stripe is subject to Stripe’s own terms and conditions.

Prices are quoted in Brazilian Reais (BRL). You are responsible for any applicable taxes, currency conversion fees, or other charges imposed by your financial institution.

6. Access Period

Upon successful payment, you will have access to the full Service until February 28, 2026. After this date, your access will expire automatically. This expiration date is fixed and applies to all users regardless of when payment was made.

We reserve the right to extend the access period at our sole discretion but are under no obligation to do so.

7. Refund Policy

Because the Service offers a seven-day Free Trial at no cost, all sales after the trial period are final. No refunds will be issued once the one-time fee has been charged, except as required by applicable law.

If you believe a charge was made in error (for example, you cancelled during the trial but were still charged), please contact us at contato@albertconcursos.com within 30 days of the charge, and we will investigate and process a refund if appropriate.

8. Intellectual Property

All content available through the Service, including but not limited to audio lessons, text scripts, subtitles, lesson plans, user interface design, and software code, is the exclusive property of 3OHT LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from the Service without our prior written consent.

Exam questions referenced in the content are used for educational commentary purposes. Original exam questions remain the intellectual property of their respective owners (e.g., CEBRASPE).

9. Prohibited Uses

You agree not to:

  • Share your account credentials with any third party;
  • Download, record, or redistribute any audio or text content from the Service;
  • Use the Service for any commercial purpose or to benefit any third party;
  • Attempt to reverse engineer, decompile, or disassemble the Service;
  • Use automated systems (bots, scrapers, etc.) to access the Service;
  • Circumvent or disable any security or access control features of the Service;
  • Use the Service in any way that violates applicable laws or regulations.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee any particular exam results or outcomes from using the Service. The Service is an educational tool and is not a substitute for formal instruction, professional advice, or independent study.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3OHT LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless 3OHT LLC and its officers, directors, members, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us at contato@albertconcursos.com. If your account is terminated after payment has been made and before the access period expires, no refund will be issued unless otherwise required by law.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction and venue of such courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3OHT LLC with respect to the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties regarding the Service.
